Do not use a parent’s home to borrow

Why a child should not arrange a Hong Kong second mortgage or owner loan on a parent’s home unless the parent understands the documents. Includes pressure on older owners.

The home is theirs. The default reaches them

A child needing cash is not a reason to cash out or second-mortgage a parent’s home. The registered owner is the person the charge affects. If the parents still live there, default affects their housing. A child’s promise to pay the instalment does not cancel the security.

China Prestige Capital does not encourage a mortgage arranged while a parent does not fully understand it. An enquiry can stop because the owner has not clearly agreed. That is a protection, not extra paperwork.

An older owner has to understand the papers

Age, hearing, sight, or unfamiliar loan language is a reason to slow down, not to sign in a hurry. Parents should have their own time and, preferably, their own solicitor, rather than a retelling by a child or a broker. Retellings leave out the sale clause.

If a parent cannot understand the document at the time, they should not sign. We will not supply a declaration designed to skip understanding. If you suspect someone is pressing an older person to sign, stop that arrangement and speak to someone the older person trusts.

Helping with bills is not authority to charge the flat

Paying a parent’s daily bills does not authorise a mortgage of the flat. Whether a power of attorney covers a charge depends on its wording and on legal advice. Do not use an unexplained authority, or a one-page document the child drafted.

If a parent is in Hong Kong and can express a wish, the parent should deal with it. Being abroad still requires a proper witnessing process. A photo of a signature in a chat is not completion.

If the money is passed to the child, the risk stays on the parent

After drawdown, transferring the money to a child does not move the mortgage off the owner. If the child later stops paying, or the money cannot be recovered, the parent’s charge does not release itself.

That is different from a personal loan the child borrows and repays without charging the parent’s flat. The risk then stays on the child’s ability to pay. That personal loan can still be declined, and the parent’s income must not be invented.

“We will arrange your parents’ loan” plus a fee is a familiar fraud

Some approaches target families with older owners, offer to cash out the parents’ flat, and take a fee first. Do not give them the identity card, address proof, or title deeds. To check, the parent or you should call 3622 2934, not a number they tell you to redial.

You have to repay your loans. Don’t pay any intermediaries. A loan the owner does not understand, and has not confirmed in writing, should not exist. Licence 1848/2025.
