Joint owners and a secured loan

Why a Hong Kong flat with more than one registered owner usually needs every owner for a second mortgage or owner loan, and what one signature does not do.

One person often cannot charge the flat alone

Joint owners means more than one name on the register. Charging that flat usually needs every owner to take the part the documents require. One willing owner, with others who disagree or are outside Hong Kong, can stop the enquiry. That is the title, not a difficult member of staff.

China Prestige Capital will not suggest hiding another owner, or signing for someone who has not read the papers. Either step can leave the arrangement unfinished and disputed.

Agreeing to borrow is not agreeing to charge

Sometimes one person wants a personal loan and another person is the registered owner. A personal loan should not put the flat into a charge without consent. An owner loan or second mortgage always touches the flat. Say at home, before you start, whether this enquiry uses the property.

If only one owner’s income will pay, the others can still bear the risk to the flat. The person paying should explain that. “I will pay the instalment” is not the whole story.

An owner who is abroad still has to be dealt with

Being outside Hong Kong does not remove an owner. Whether a power of attorney is acceptable, and what notarisation or witnessing it needs, depends on the documents and on legal advice. Do not buy an unexplained template. This article does not supply one, and it does not promise that any particular authority will be enough.

A short timetable is not a reason to skip an owner. After the money has been spent, a missing signature is harder to repair.

Divorce, estates, and unfinished assignments

A divorce, family proceedings, an estate still in probate, or a sale that is not yet registered is not an ordinary joint tenancy. Court papers, a grant, or the sale contract have to be read first. Until the title is clear, a secured enquiry may not proceed.

Do not file a disputed address and expect same-day cash. The review can wait for documents, or it can stop.

Each owner should be able to ask a solicitor

Independent advice should be available to each person who must sign, not only to one of them. The lender’s explanation follows the lender’s documents. It does not replace each owner’s own solicitor.

An enquiry is worth sending after every owner understands and agrees. Hotline 3622 2934. Before written confirmation, nobody should pay a broker.
